1. ABOUT US

These are the Terms and Conditions for Birth Coaching by Bryony, operated by Bryony Warden.

2. SERVICES PROVIDED

We provide Birth Preparation courses for expectant parents. Including:

·       Private Hypnobirthing Courses held in person, or online via zoom. (Clients are responsible for ensuring they have suitable internet access and equipment to participate in online sessions)

·       Private Hypnobirthing Courses specifically for those planning a Caesarean Birth.

·       Private Hypnobirthing Courses tailored to those who have previously birthed using Hypnobirthing techniques and request a refresher.

Our services are intended for expectant parents from the gestational age of 20 weeks, and their chosen birth partners.

Please note: Our services are educational in nature and do not replace medical advice or treatment. We are not medical professionals and do not claim to be, and so any questions on the health and wellbeing of any participants should be directed to your healthcare provider.

3. BOOKING & PAYMENT

3.1 How to Book

Bookings can be made:

·       Online via our website

·       By email to: support@birthcoachingbybryony.com

·       By phone: 07557440500

·       Through a direct message on our Facebook or Instagram Pages

3.2 Payment Methods

We accept payment by:

·       Bank transfer (preferred)

·       Cash

·       Debit and credit card payments via Stripe

3.3 When Payment is Due

·       1:2:1 Courses: Payment required as follows: 50% deposit at booking, remainder 7 days before session. Full payment can be taken at booking if preferred.

3.4 Confirmation

Your booking is confirmed when:

·       Deposit has been received.

·       You have received a confirmation email from us

4. CANCELLATION POLICY

4.1 Cancellation by You (the Client)

1:2:1 Courses:

·       Cancellations made 7 or more days before the course starts: Full refund minus £20 admin fee

·       Cancellations made 2-7 days before the course starts: 50% refund

·       Cancellations made less than 48 hours before or after course has started: No refund

·       No-shows: Full session charge

 

Please note: We do of course understand that pregnancy and birth related emergencies do occur, and so in those instances we do strive to be flexible and offer one free reschedule.

4.2 Cancellation by Us

We reserve the right to cancel any class or service with 24 hours notice due to:

·       Instructor illness or emergency

·       Venue unavailability

·       Severe weather or circumstances beyond our control

If we cancel:

·       You will have the choice of receiving a full refund OR credit to use on another class or service

·       We will notify you by email/text/phone as soon as possible

·       We are not liable for any indirect costs you may have incurred (travel, childcare, etc.)

4.3 Pregnancy & Birth Considerations

We understand that pregnancy and new parenthood are unpredictable.

If you go into labour before a scheduled course/session, we will offer you: a full refund OR a credit note valid for 36 months.

If your baby arrives early and you cannot attend remaining sessions, we will provide a pro-rata refund for any unused sessions.

5. HEALTH & SAFETY

5.1 Your Responsibility

By booking with us, you confirm that:

·       You are at least 20 weeks pregnant (unless otherwise agreed)

·       You will inform us immediately if your health circumstances change

5.2 Right to Refuse Service

We reserve the right to refuse service or ask you to stop participating if:

·       We believe it is unsafe for you to continue

In such cases, you will be offered a pro-rata refund.

 

5.3 Participating at Your Own Risk

While we take all reasonable precautions to ensure your safety, you participate in our classes at your own risk.

You should:

·       Listen to your body and stop if something doesn't feel right

·       Ask questions if you're unsure about any movement or activity

·       Stay hydrated and take breaks when needed

6. ATTENDANCE & CONDUCT

6.1 Late Arrivals

Please arrive 5-10 minutes before your class starts.

If you arrive more than 15 minutes late:

·       No refund or credit will be given, and the session will still conclude at the planned time.

6.2 What to Bring

If attending a course at a venue other than your home, please bring:

·       Cushions/pillows, blanket, notepad & pen, water

6.3 Children & Siblings

Older siblings are of course welcome as this is a family friendly course, however we personally feel you would enjoy the course more without interruption or disruption.

6.4 Behaviour

We reserve the right to ask you to leave without refund if:

·       Your behaviour is disruptive or disrespectful

·       You are under the influence of alcohol or drugs

·       You behave in a way that makes others uncomfortable

We aim to create a safe, welcoming, inclusive space for all.

7. PHOTOGRAPHY & SOCIAL MEDIA

7.1 Photo Consent

We may take photographs or videos during classes for:

·       Social media promotion

·       Website content

·       Marketing materials

By attending our classes, you consent to being photographed unless you have specifically opted out. You can opt out at any time by emailing us.

We will never tag you or use your name without explicit permission.

Photos of babies/children will only be shared with explicit written consent from the parent, in which case a separate form will be provided for signing.

7.2 Your Own Photos/Videos

You are welcome to take photos for personal use, but please:

·       Do not share photos that include other participants without their permission

·       Do not photograph or video other people's children

·       Do not livestream or record the class without permission

 8. INTELLECTUAL PROPERTY

All materials provided (handouts, guides, videos, course content, etc.) are protected by copyright and are for your personal use only. Course materials may not be uploaded to social media, file-sharing websites, AI training systems, or distributed electronically without written permission.

You may not:

·       Copy, reproduce, or distribute our materials

·       Share recordings or course content with others

·       Use our materials for commercial purposes

·       Teach our methods without appropriate training and permission

9. INSURANCE & LIABILITY

9.1 Our Insurance

We hold Public Liability Insurance with Holistic Services Insurance.

A copy of our insurance certificate is available on request.

9.2 Limitation of Liability

To the fullest extent permitted by law:

·       We are not liable for any injuries sustained during classes if you have not disclosed relevant medical conditions

·       We are not liable for loss or damage to personal property

·       We are not liable for any indirect costs (travel, childcare, etc.) if we need to cancel

·       Our liability is limited to the amount you have paid for the service

This does not affect your statutory rights or our liability for death/personal injury caused by our negligence.

10. DATA PROTECTION & PRIVACY

We collect and store your personal information (name, contact details, medical information) in accordance with UK GDPR and Data Protection Act 2018.

10.1 What We Collect

·       Contact information (name, email, phone)

·       Medical information relevant to safe participation

·       Booking and payment history

10.2 How We Use It

·       To provide our services to you

·       To contact you about your bookings

·       To send important updates about classes

·       To ensure your safety during activities

·       To send marketing emails - only if you've opted in

10.3 How We Store It

·       Securely on encrypted platforms

·       For as long as necessary to provide services and for legal requirements

·       We will never sell your data to third parties

10.4 Your Rights

You have the right to:

·       Access your data

·       Correct inaccurate data

·       Request deletion of your data

·       Opt out of marketing emails

·       Withdraw consent at any time

11. COMPLAINTS

12. CHANGES TO TERMS

We may update these Terms & Conditions from time to time.

When we do:

·       We will update the "Last updated" date at the top

·       We will notify existing clients by email

·       Continued use of our services means you accept the new terms

13. GENERAL

13.1 Entire Agreement

These Terms & Conditions (along with our Privacy Policy) constitute the entire agreement between us.

13.2 Governing Law

These terms are governed by the laws of Scotland.
